Frequently asked questions
General
What can a licensed paralegal do in Ontario?
Licensed paralegals can represent you in Small Claims Court (claims up to $50,000), at tribunals such as the Landlord and Tenant Board and the Human Rights Tribunal of Ontario, and on provincial offences such as traffic tickets. They cannot handle family law, real estate, wills or most criminal charges.
Is a paralegal cheaper than a lawyer?
Usually, yes. We charge one flat fee per service, plus HST: Small Claims Court $2,500, Landlord and Tenant Board $1,200, traffic tickets from $300, Human Rights Tribunal $2,500, and notary services $25 per document.
Do you offer a free consultation?
Yes. Call (647) 861-6962 for a free 15-minute case review. We’ll tell you your deadline, your options and the fee.
Do you speak languages other than English?
Yes. We work in English, Farsi, Hindi, Urdu and Pashto. You can explain your situation in your own language, and we explain every document and hearing step the same way.
Is Misbah Shajjan a licensed paralegal?
Yes. Misbah Shajjan is licensed by the Law Society of Ontario, licence number P20257. You can confirm it in the Law Society’s public directory at lsodirectory.lso.ca.
Where is your office?
4711 Yonge St, North York, near Sheppard-Yonge station. Many tribunal hearings are by video, so we act for clients across Ontario.
Do you still handle criminal cases?
No. We focus on Small Claims Court, the Landlord and Tenant Board, provincial offences, the Human Rights Tribunal and notary services. For criminal charges, contact a criminal lawyer or the Law Society Referral Service.
Will I know the total cost before I hire you?
Yes. The flat fee, what it covers, and any court or tribunal filing fees are set out in a written retainer before any work begins.
Small Claims Court
Can a paralegal represent me in Ontario Small Claims Court?
Yes. Licensed paralegals are authorized by the Law Society of Ontario to represent clients in Small Claims Court, from drafting the claim to arguing the trial.
How much does a Small Claims Court paralegal cost in Toronto?
One flat fee of $2,500 plus HST covers one claim or defence, from the demand letter through a trial of up to one day. Court filing fees are extra and we list them in your retainer.
What is the maximum I can sue for in Small Claims Court in Ontario?
Since October 1, 2025, the limit is $50,000, not counting interest and costs. If your claim is larger you can give up the excess to stay in Small Claims Court, or sue in the Superior Court of Justice.
How long does a Small Claims case take in Toronto?
A settlement conference is usually scheduled several months after a defence is filed, and a trial several months after that. Undefended claims can reach default judgment within weeks of service.
Can I get my legal fees back if I win?
The court can order the losing side to pay part of your representation fees, usually capped at 15% of the amount claimed, plus your court fees and disbursements.
I won but the other side still won’t pay. What now?
A judgment can be enforced by garnishing wages or bank accounts, filing a writ against property, or summoning the debtor to an examination hearing. We quote enforcement separately after judgment.
Should a landlord sue a former tenant in Small Claims Court or at the LTB?
If the tenant has already moved out, a claim for unpaid rent or damage generally goes to Small Claims Court. If the tenant still lives in the unit, it goes to the Landlord and Tenant Board.
Landlord and Tenant Board
How much does an LTB paralegal cost in Ontario?
One flat fee of $1,200 plus HST for one application, for a landlord or a tenant, from the notice to the hearing. LTB filing fees are extra.
Do you represent tenants as well as landlords?
Yes. We act for both landlords and tenants, but never for both sides of the same dispute.
How long does an eviction for non-payment take in Ontario?
It depends on the notice period and how quickly the LTB schedules a hearing. Serving a correct N4 the first time is the biggest thing a landlord controls, because a defective notice restarts the clock.
Can my landlord evict me so a family member can move in?
Only with an N12 served in good faith for the landlord, their spouse, child, parent, or a caregiver, who must intend to live there for at least a year. You are entitled to compensation equal to one month’s rent.
What can I do if my landlord won’t fix my unit?
A tenant can file a T6 application. The LTB can order repairs, a rent abatement, and in some cases let you pay rent into the Board until repairs are done.
What changed at the LTB with Bill 60 in 2026?
Two changes matter most. For N4 notices given on or after September 21, 2026, the termination date can be as early as 7 days after the notice is given, instead of 14. And since July 1, 2026, you have 15 days, not 30, to ask the LTB to review an order. Notices served before a change follow the old rules.
Traffic Tickets and Provincial Offences
Is it worth fighting a speeding ticket in Ontario?
Often yes. A conviction affects demerit points and usually raises your insurance for three years, which can cost more than the fine. Many tickets are resolved to a lower speed or fewer points.
How much does a paralegal cost for a traffic ticket in Toronto?
Our fee for a standard ticket is $300 plus HST. Serious charges such as careless driving, stunt driving or no insurance get a fixed quote after a free review.
Do I have to go to court?
For most Part I tickets a paralegal can appear for you. Some charges and proceedings may need you to attend, and we tell you in advance.
What happens if I miss the 15-day deadline?
You may be convicted without a hearing. It is sometimes possible to reopen the case, but you need to act quickly. Contact us as soon as possible.
Can a paralegal help with criminal driving charges?
No. Impaired driving and dangerous driving are criminal charges and need a criminal lawyer. We will tell you if your charge falls into this category.
Human Rights Tribunal of Ontario
How long do I have to file an HRTO application?
Generally within one year of the last incident of discrimination. If the incidents were a series, the year runs from the last one. Late applications are accepted only in limited cases.
How much does an HRTO paralegal cost?
One flat fee of $2,500 plus HST covers drafting and filing your application or response, disclosure, and representation at mediation. If the case goes to a hearing, we quote that separately before any work.
Can I file at the HRTO and also sue my employer?
You cannot get compensation for the same discrimination twice. Sometimes a wrongful dismissal claim in court can include a human rights claim. We help you choose the right route.
What compensation can the HRTO award?
The Tribunal can order lost wages, compensation for injury to dignity, feelings and self-respect, and non-monetary remedies such as policy changes or training. Amounts depend on the facts.
Do you represent employers and landlords?
Yes. We help respondents file a response on time and resolve applications at mediation where possible.
Notary Public and Commissioner of Oaths
How much does a notary cost in North York?
$25 plus HST per document, for commissioning affidavits and statutory declarations, certified true copies and notarized signatures.
What is the difference between a commissioner of oaths and a notary public?
A commissioner of oaths can witness affidavits and declarations. A notary public can also certify true copies and notarize signatures, which is often needed for documents used outside Ontario.
Should I sign my document before I come?
No. You must sign in front of us. Bring the document unsigned with government photo ID.
Do you offer same-day notary appointments?
Often, yes. Call (647) 861-6962 and we will find the earliest time.
